NineCrafts supports makers, original creative work, digital downloads, genuine vintage goods and approved craft supplies. These rules explain what sellers may offer and the standards sellers and NineCrafts must follow.
Policy version: October 22, 2026. These rules apply when accepted at enrollment or when you accept a properly notified later version. Publishing them does not open the marketplace, activate payments or establish that a service is available. Mandatory legal rights are not waived.
Key terms
- Seller or shop: the person or business responsible for its listings and orders.
- Maker: a seller who makes or meaningfully customizes eligible physical products, creates original digital files, or has qualifying designs made by a disclosed production partner, under these rules.
- Handmade or hand-customized: the seller makes the item or adds its design details by hand, such as painting, stitching or carving.
- Machine-customized: programmed equipment reproduces the design, such as a printer, laser, CNC or embroidery machine, even if the seller operates it. Ordinary tools do not automatically make work machine-customized. The distinction is who creates the detail: a person controlling it by hand, including hands-on work with a sewing machine, or equipment reproducing a programmed design.
- Original design: a design you create. The originality section explains limited exceptions for licensed work and handcraft patterns. Production partner: an outside business that makes your qualifying design; a supplier of blanks or materials alone is not a production partner.
- Digital download: a file delivered electronically, not a physical product.
- Craft supply: an eligible material, tool, component, blank, kit or other approved supply used for crafting, whether resold or manufactured.
- Vintage: at least 20 years old when listed, not merely new and vintage-styled.
- Ships from the USA: the customer’s parcel actually starts its journey at an eligible U.S. location. It does not mean the product was made in the USA.
- Processing time: time to prepare or make an order. Dispatch: handing it to the carrier. Transit time: the carrier’s journey after dispatch; an estimated delivery date is not a guaranteed carrier outcome.
- Base commission: the category rate before the qualifying promotion. A one-percentage-point discount changes 5% to 4%; it is not a relative 1% reduction. All rates appear once under Fees.
- Deadline terms: business days are Monday–Friday, excluding U.S. federal holidays. Support and review use U.S. Central Time. Counting begins on the next business day after receipt; business-day deadlines end at 5 p.m. Central. Calendar-day deadlines end at 11:59 p.m. Central unless a legal deadline or notice says otherwise.
What you may sell
Independent shops may sell handmade work, original art and designs, meaningful customizations, original digital files and approved supplies together. Separate maker and supply shops are optional. Classify each listing honestly as a craft, original design, digital download or supply; its actual product determines the applicable eligibility, originality, photo, inventory, shipping and safety rules. Each shop needs its own supply approvals. Common ownership cannot bypass a restriction. Vintage shop placement remains unresolved below; NineCrafts’ own retail operation remains supply-only.
Unchanged generic finished merchandise cannot be resold as maker work. Genuine vintage and approved supply sales have their own limited eligibility rules.
Meaningful customization
Customization must add substantive skilled or creative work for the buyer, not just repackage, relabel or resell unchanged wholesale goods. Explain who made the item and your actual contribution. Engraving your original design on a purchased blank may qualify; reselling an unchanged wholesale mug does not.
Makers may buy blanks, raw materials and components, use tools and machines in their home or shop, and make products to order. The hand/machine distinction above does not override originality or licensing: adding a name does not make a purchased template original. Follow the pattern, machine-production and partner rules below.
Vintage goods
Vintage goods need not be made or designed by the seller, but must be at least 20 years old when listed. New reproductions and “vintage-style” goods do not qualify. Eligible types include clothing, shoes, bags, jewelry, furniture, décor, dishes, books, lamps, electrical goods, toys and collectibles, subject to the safety rules. Vintage supplies and tools also follow the supply rules.
Clearly distinguish vintage from your own creative work. State its age, or an honest estimate and its basis; disclose condition, damage, repairs and alterations. The physical-product photo and U.S. dispatch rules apply.
Age alone does not ban lamps, dishes or toys, but unsafe products are prohibited, including shock, choking or strangulation hazards even without a recall. Unresolved recalls, strollers, car seats, infant sleep products, firearms, prohibited weapons, explosives and prohibited hazardous goods remain excluded regardless of age. See Product safety and prohibited conduct.
UNDER DISCUSSION: vintage shop placement. Vintage eligibility and its commission are approved, but whether it belongs in a separate shop or alongside other products is not decided. Permission to mix maker products and supplies does not authorize adding vintage to those shops.
Original work and legal rights
Maker products must use your original design, qualify under the limited first-license exception below, or be handcrafted from a purchased pattern as allowed here. These maker-origin rules do not apply to supplies, but every seller needs the legal rights to all protected elements in products, photographs, listings, packaging and files, including customer-supplied material. Buying or commissioning artwork, owning an object or saying “inspired by” does not itself grant copyright, trademark, patent or publicity rights. A legal license can still fail NineCrafts’ eligibility standard; eligibility is not a legal ownership ruling.
Purchased handcraft patterns: you may handcraft products by sewing, knitting or similar hands-on work from a purchased pattern if you have the rights to make and sell them. You need not hold the first license, but must not claim to have designed the pattern. Ordinary hand tools and sewing machines are allowed.
Bought templates and machine production: do not reproduce purchased templates, patterns or ready-made designs as finished goods using print-on-demand, CNC, plasma cutters or similar template-driven production. Single items, small batches, commercial licenses and first-license status do not avoid this ban. Machine production and print-on-demand remain allowed for your original designs and qualifying original commissioned designs, subject to the partner rules.
Digital files: downloads must be original files created by you or your shop’s disclosed creative team. Do not relist purchased artwork, templates, patterns, stock collections or resale-rights bundles as your own. A license for physical products does not automatically permit file resale; the first-license exception never permits it.
First and original license holder
Except for the handcraft-pattern permission above, unchanged purchased ready-made graphics on a physical product qualify only under this limited exception. It does not override the bought-template machine/POD ban.
You must be the first seller or seller business, in time, to receive a written commercial license for the identified design directly from its original creator. Merely buying directly or being first in a resale chain is insufficient. Keep a dated agreement naming the design, creator, holder, permitted products and commercial uses; the creator’s confirmation that it was the first commercial license; and evidence it remains valid and covers any partner. A receipt or generic commercial-use certificate alone is insufficient.
Later direct licenses, sublicenses, resale bundles and transfers to another seller do not qualify. Simultaneous grants to separate sellers cannot create multiple first holders. A jointly owned business may hold one license; unrelated shops cannot share a grant to bypass this rule.
Exclusivity is unnecessary unless the license requires it; the creator may retain ownership and sell their work. Original commissioned work may qualify through the documented first direct license, but buying an existing template or commissioning its reproduction does not make an original commissioned design. Commissions, assignments and business transfers do not erase earlier licenses. Ownership changes within the same licensed legal business preserve status only while the license stays valid; transfer to a different seller creates no new first holder.
Keep reasonable creation evidence, such as sketches, source files, prototypes, dated photos or work-in-progress records. NineCrafts may request relevant records for a specific concern, not unrelated private information or another person’s confidential files without authority. See Copying and design protection for how this evidence is assessed, reports and review.
AI and creative work
Generative AI may not supply the artwork, pattern, design, instructions or other substantive creative work sold as a maker product or original download. Prompting and minor edits do not make it original; relabeling it as a supply cannot evade the rule.
Routine assistance is allowed: spelling, translation, inventory administration, accurate AI-written listing descriptions and photo-background cleanup that does not misrepresent the item. Conventional design software, digital drawing, accessibility tools and machine-assisted production remain allowed for eligible work. Sellers remain responsible for accuracy; the restriction is on generated creative substance, not computers or assistive tools.
Do not fabricate finished products, hide defects, invent endorsements or misrepresent a making process with generated images. A subscription or prompt does not establish exclusive rights. AI-detection scores alone are not proof; review must consider creation records, source files, process evidence and your explanation, with normal appeal rights.
Production and U.S. shipping
Every physical customer shipment must actually originate at a disclosed location in the 50 states, District of Columbia, Puerto Rico, U.S. Virgin Islands, Guam, Northern Mariana Islands or American Samoa. A U.S. label, tracking number, return or forwarding address cannot disguise an overseas-origin customer parcel. Lawful bulk imports of blanks, materials and eligible supplies stocked here before customer fulfillment may qualify.
Delivery is allowed within those locations and to APO, FPO and DPO addresses where lawful and carrier-supported. Disclose the destinations you serve and shipping charges before purchase. Overseas military destinations do not permit overseas dispatch. Other international destinations and local pickup are not offered under this version.
Digital files need no shipping, but checkout has the same U.S. geographic limits; military-address customers may use an eligible billing arrangement. These limits do not impose seller citizenship, residence or manufacturing-origin requirements. Sellers must meet their payment service’s eligibility and account verification requirements.
“Made in the USA,” handmade, local and domestic-content claims must be accurate and supported; U.S. dispatch alone proves none of them.
State the real dispatch location and realistic production/handling times. Do not accept an order you cannot fulfill under these rules, conceal a change or substitute overseas fulfillment after purchase. NineCrafts must review discrepancies between actual dispatch, disclosed origin and return addresses, and let you explain with relevant records. A legitimate documented difference is not automatically a violation. An unexplained or misleading mismatch, false origin information or concealed prohibited fulfillment may lead to warning, restriction or suspension, proportionate to the evidence and seriousness, with written reasons and human appeal.
Production partners and print-on-demand
Outside partners and print-on-demand may make qualifying physical maker products, not unchanged wholesale/catalog goods or machine-reproduced bought templates. For your original designs, partners may ship directly to buyers from an eligible U.S. location. You must control the qualifying design, hold manufacturing rights, and remain responsible for quality, listings, dispatch, customer service, returns and remedies.
Before the first partner-produced listing, disclose your creative role, the partner’s production role and actual U.S. dispatch location. Give NineCrafts the partner’s legal identity and fulfillment details privately. You may protect its name publicly, but must describe its work and location truthfully and not claim outsourced work as personally manufactured. Update changes before affected orders and prevent overseas routing.
Inspect a representative finished sample and keep dated photos for each materially different product type and process. Recheck partner, material or process changes that could materially affect results. Each personalized variant does not need a new sample. Labeled mockups may supplement, not replace, truthful sample evidence. There is no partner-registration fee or fixed listing-count cap; eligibility and safety reviews still apply.
Buying materials alone does not create a production-partner relationship. Applying a shop label or choosing an unchanged supplier template is not original design. In-house printing, embroidery, laser/CNC/plasma work and 3D printing may make eligible maker work. Approved supply shops may machine-manufacture genuine supplies and parts, not relabel finished consumer goods as supplies.
Approved craft supply sales
Approval before selling
Each shop needs NineCrafts approval for supplies and for every main category and subcategory it sells in, including mixed shops. A main-category approval does not automatically approve its subcategories. Obtain additional approval before expanding; do not list unapproved supplies while review is pending. Eligible products within approved subcategories need no individual manual approval, but must comply and be supportable in an audit or specific investigation. Maker products and original downloads may be listed under their own rules.
Applications and category reviews are free. Provide business identity, requested categories/subcategories, representative inventory, relevant supplier/authenticity records, U.S. fulfillment arrangements and applicable safety records. Approval must name each permitted category/subcategory in writing. Category names, requirements and required evidence must be published before enforcement; no penalty for an unpublished restriction. Immediate safety or legal restrictions still apply with an explanation.
NineCrafts targets two business days to identify missing information specifically, and five business days for a decision after required evidence is supplied. If delayed, explain and update every five business days. Silence is not approval. Category-addition requests use the same free process. Denied, restricted or revoked approvals require reasons and a review/appeal route; you may supply missing information or challenge errors. Distinguish a product problem from a category-wide or shop-wide problem.
Supply category catalog
Each semicolon-separated group below is a separate subcategory. Approval for jewelry beads, for example, does not authorize painting brushes.
- Fiber, textiles, and sewing: fabric/interfacing; yarn/roving/spinning fiber; thread/embroidery floss; sewing notions/fasteners; knitting/crochet/weaving/needlework tools.
- Jewelry and metal crafts: beads/stones/cabochons; findings/chain/wire/stringing materials; sheet metal/metal clay/jewelry blanks; jewelry-making/finishing tools.
- Paper, printing, and stationery: paper/cardstock/envelopes/bookbinding materials; paper/stationery blanks; stamping/embossing supplies; cutting/binding/printing consumables.
- Painting, drawing, and fine art: canvas/panels/art surfaces; drawing media; paint/ink/pigments; brushes/palettes/application tools; art adhesives/sealers/finishes.
- Wood, leather, and natural materials: wood blanks/boards/veneers; leather/cork/working materials; carving/working tools; craft hardware/fasteners; lawful dried botanical/animal-derived materials.
- Molding, casting, and sculpture: molds/mold-making materials; clay/modeling materials; casting powders; resins/hardeners/additives; sculpting/casting tools.
- Candle, soap, perfume, and cosmetics: waxes/wicks; soap ingredients/bases; fragrance/essential oils; cosmetic oils/butters/actives/preservatives/formulation ingredients; formulation alcohols/solvents/processing aids; mixing/measuring/filling tools.
- Customization blanks and components: blank apparel/textiles; blank drinkware; sign/ornament/décor blanks; accessory blanks/unfinished components; transfer/sublimation/customization consumables.
- Craft equipment and parts: hand tools; sewing/embroidery machines; cutting/printing equipment; consumer craft-fabrication equipment; replacement parts/equipment consumables.
- Kits, storage, and packaging: craft kits/assortments; craft storage/organizers; protective/gift packaging; bottles/jars/tins/containers; commercially published physical craft instructions/patterns/reference books.
Restricted-category safety rules also apply. A permitted supply does not automatically grant the buyer qualifying maker-design rights; physical instruction books do not permit resale of someone else’s digital files.
Supply listings and stock
Offer genuine materials, tools, components, blanks, kits and other supplies within your approved categories. Resale and manufacture, including mass-produced supply parts, are allowed; unrelated merchandise, finished consumer goods outside those categories and prohibited products are not. Clearly label supply status and the shop’s supply approval. Approval is not an inspection or endorsement of every item.
Accurately describe brand, materials, specifications, quantity, condition, availability, handling and your actual manufacturing role. Purchased commercial supplies are not handmade by your shop. Keep appropriate supplier/authenticity records; claim authorized-dealer status, manufacturer warranties or certification marks only when entitled. Kits must state contents, what buyers supply, and relevant skill, tool, age and safety requirements. Approval waives neither safety nor intellectual-property rules.
Supply photo: each listing needs at least one buyer-visible original, unedited photograph taken by the selling business of the actual product for sale, not a supplier/catalog copy or AI image. No separate storage or proof photo is required.
Stock before listing or sale: the business must own paid-for merchandise already in its physical custody at a U.S. home, shop or storage location it operates. For manufactured supplies, purchased materials/components must be owned and paid for, and finished stock already made and held. Renting the premises is allowed; ownership of the merchandise, not the property, is required.
Ship from that declared business-operated inventory location, with its ship-from ZIP Code matching the location registered for the shop. A matching label cannot disguise another origin. No supply dropshipping, including a wholesaler or third-party warehouse holding stock or fulfilling orders for you. Carrier sorting/processing ZIPs alone prove neither dispatch origin nor a mismatch. You need not display a home address publicly.
The packaging itself must identify the shop through a printed or affixed name, logo, business address or other identifying feature. An enclosed insert/packing slip alone is insufficient; no home address is required. You remain responsible for inventory, dispatch, packaging and remedies despite supplier errors. Do not substitute products, use customer information for unrelated purposes or dispatch customers’ parcels overseas.
Mixed shops, ownership and classification
Clearly distinguish maker products, downloads and supplies in listings, browsing, badges and advertising. Original downloads cannot be relabeled as resold supply files; supply approval cannot admit generic finished goods into maker categories. Rates and promotional qualification are under Fees.
Disclose the people/businesses owning or controlling the supply operation and related shops at approval and when they change. Shared addresses or family relationships alone do not prove common control; NineCrafts must assess the actual relationship and explain restrictions. Buying from an independent manufacturer does not make it part of your business, and actual common control cannot be concealed as an independent supplier arrangement.
Supply bundles may contain only eligible supplies, not finished maker goods. List eligible maker goods separately; makers may still buy inputs for their products and use ordinary protective packaging. Measuring, dividing, packing and labeling purchased supplies is fulfillment, not maker work. Genuine supply manufacturing remains allowed.
Knowingly misclassifying supplies as crafts, original designs or downloads to evade rules will be penalized through the existing proportionate-enforcement process. NineCrafts must assess evidence and your explanation, distinguish honest mistakes from deliberate evasion, give written reasons, and preserve correction and human appeal. Category access may be restricted/revoked; serious or repeated violations may lead to suspension. There is no new penalty schedule or authority for monetary fines.
Supplies sold by NineCrafts
NineCrafts may resell or manufacture eligible crafting supplies, tools and materials, never crafts or custom work, through any business, brand or shop it owns or controls. It will seek cost-effective sources and purchasing opportunities for practical value and clearly identify itself as retailer. Independent supply shops choose their own prices and discounts.
Seller purchase discount: approved maker and supply-store accounts that are not suspended receive 10% off NineCrafts’ regular public merchandise price, or the lower available public sale price. Discounts do not stack unless expressly permitted; tax, shipping and gift cards are excluded. Unsupported complaints alone do not remove eligibility. The discount is nontransferable, has no cash value and creates no entitlement to unavailable stock.
NineCrafts’ retail operation follows the same applicable listing, shipping, service, safety and review standards as independent supply shops. Buying from it is optional, never a condition of selling, ordinary support or winning a dispute, and never improves unpaid search ranking, enforcement treatment or jury outcomes.
Confidential seller designs, source files, sales, customer, supplier or application information cannot be used to copy products or source, price or promote competing NineCrafts products. Operational access grants no competitive-use permission. Retail staff with a commercial conflict cannot decide competing-store complaints; disputes about NineCrafts retail go to a reviewer without responsibility for it. Statutory consumer rights remain.
Identify sponsored/editorial placements and NineCrafts-owned listings clearly. Platform ownership cannot be a hidden organic-ranking advantage.
Digital downloads
Follow the original-file rules above. Files must work for their stated purpose and contain no malware, hidden tracking, stolen credentials or undisclosed executable code. Buyers must not need unrelated sign-ups or extra payments to obtain included contents.
Every listing must say “Digital download — no physical item” and state file types/contents, relevant dimensions/resolution, software/equipment requirements, and immediate or made-to-order delivery. Use representative previews; do not imply that a pictured frame, garment, machine or materials are included.
Instructional-file photo: patterns, recipes and similar instructions need at least one original, unedited photograph taken by you or your team of a finished physical result made using them. A preview, mockup, rendering or AI image alone is insufficient. Purely digital art, software and other files not instructing a physical result need no such photo.
NineCrafts must retain the digital-only label in cart, checkout and receipt, explicitly confirm no physical shipment at checkout, and separately obtain and record any legally required immediate-delivery consent.
State the license before purchase: personal/commercial use, permitted quantities/uses and redistribution restrictions. Do not promise rights you cannot grant or retroactively change a purchased license. Identify bundle contents; the same originality rules apply. For custom files, record scope, required buyer inputs, revision allowance, delivery date and approval steps; no undisclosed revision or release fees.
Digital cancellations and remedies
- Instant-file cancellation: within 14 calendar days of purchase if the paid file has not been accessed/downloaded. Access means an authenticated action supplying the usable paid file. Previews, confirmation pages, automated email scans and merely sending a link do not prove access; keep reliable event records. After access there is no automatic change-of-mind refund. Missing legally required consent cannot be used against the buyer.
- Custom files: use the 24-hour cancellation and documented-work rules under Returns and order disputes. Correcting your failure to supply the agreed file is not an extra paid revision.
- Problems: report ordinary delivery/conformity problems within 30 calendar days of promised or actual delivery, whichever is later. Non-delivery, corruption, material misdescription, failure to perform the stated function and duplicate charging remain remediable despite a “no refunds” term or download log. Where appropriate, offer a working conforming replacement within five business days, without delaying a legally required refund; refund if the promised product cannot be supplied or the defect resolved. Do not require physical returns for digital disputes.
- Duplicate purchases: the same buyer may report an unnecessary duplicate of the same file and license within 14 calendar days for reversal. Intentionally bought additional licenses are not duplicates.
Instant-file delivery means making the files available through the agreed access route; a later download does not restart the claim period. Custom delivery means providing the completed agreed files. Delivery and authenticated access are different events.
Mandatory rights remain. Verified platform failures or misleading notices preventing a timely report justify extensions. Refund-decision appeals follow the separate Filing windows and review targets below.
Fees
Commission rates and promotional qualification
Rates apply to each listing’s actual category, not the whole shop. Parentheses show the rate after the qualifying social-media discount:
- Handmade or hand-customized by the seller: 4% (3% after discount).
- Machine-customized by the seller: 5% (4% after discount), even when you operate the equipment.
- Original digital downloads: 5% (4% after discount).
- Original designs made by a production partner: 5% (4% after discount).
- Craft supplies and tools: 5% (4% after discount).
- Vintage resale: 7% (6% after discount).
To qualify a listing, put links to two different online posts promoting that product or NineCrafts in its promotional-link fields. Links may be spot-checked; qualification does not extend automatically to other products. All six categories qualify for the same one-percentage-point reduction, not a relative 1% discount. Payment processing is separate, as is the 10% seller purchase discount on NineCrafts supplies.
A mixed shop’s products remain one seller order even with different rates. Separate shops remain separate seller orders even in one checkout or with a common owner. All schedule amounts are U.S. dollars. Rates do not waive eligibility or supply approvals, or decide vintage shop placement. Fee changes require this agreement’s notice and acceptance process and cannot alter accepted transactions or their promotional terms.
Commission calculation
The base is merchandise you are entitled to receive before fees: the buyer’s merchandise payment after discounts plus any itemized NineCrafts-funded reimbursement promised to you. Seller-funded discounts reduce it; a platform promotion cannot silently reduce promised proceeds.
Exclude taxes, tips and genuine separately stated shipping. Include customization, gift wrapping sold with the item and required item charges. Do not disguise merchandise value as shipping. Allocate order-wide discounts proportionately among eligible lines unless a different allocation was disclosed before purchase; identify who funds them.
Use exact decimals: for each seller order, multiply each product’s commissionable merchandise by its applicable rate, add unrounded results, then round the total once to the nearest cent, half cents up. There is no minimum commission. These base, allocation, exclusion and rounding rules apply to every category.
Other charges and optional advertising
Optional services require separate enrollment and cannot be charged before they are available. Disclose every required charge before commitment, distinguishing commission, processing, taxes, shipping services, optional advertising and other charges, with calculation bases and refund treatment. Statements must itemize deductions, credits and resulting payout. No unexplained adjustments, duplicate collection or undisclosed rate because a provider’s final charge was unknown. Sellers may request itemized explanations and challenge calculations without admitting wrongdoing; incorrect or duplicate NineCrafts charges must be corrected.
There are no NineCrafts setup, application, listing, renewal, membership, ordinary report, review, appeal or standard-payout fees. No paid advertising, offsite-attribution or expedited-payout service/charges are offered under this version. NineCrafts-funded editorial promotion creates no seller advertising bill.
Sellers pay actual applicable provider processing, conversion, payout and chargeback charges without NineCrafts markup. Disclose their rate/calculation before payment activation or choosing the service. Identify legally required service taxes separately. Provider credits return to whoever originally bore the charge, without duplicate recovery.
A later paid-ad program requires a properly notified policy amendment defining pricing and attribution, then separate affirmative enrollment, a clear price/budget and a way to stop future charges. Participation stays optional regardless of sales volume; cancellation does not erase valid charges already incurred. Label sponsorship. Payment cannot influence enforcement or jury outcomes. Sellers must be able to challenge attribution/charges with useful details of the event, attribution period and charged order while buyer privacy is protected; correct unsupported charges. None of this authorizes current ad charges.
Refund credits and shared provider charges
For merchandise refunds, credit the same proportion of the original recorded seller-order commission as the proportion of commissionable merchandise reversed, even for mixed-rate orders. Never combine different seller orders or recalculate using current rates or later promotional qualification.
For repeated partial refunds: cumulative credit equals original rounded commission × cumulative commissionable merchandise reversed ÷ original commissionable merchandise. Round this cumulative entitlement once to cents; the new credit is that amount minus credits already issued. A full reversal credits the full original commission, never more. A zero original merchandise subtotal means zero commission and credit; do not divide by zero.
A platform-funded reimbursement counts as reversed only when removed from your entitlement. A refund wholly funded by NineCrafts without reducing that entitlement creates no seller commission credit. Shipping-only and tax-only refunds do not change commission. Provider charges actually retained may remain payable under disclosed terms; refunded provider charges must be credited back.
If one provider charge covers several sellers, allocate it in proportion to each seller’s share of the provider’s calculation base. Never charge each seller the whole shared fixed fee; total allocations cannot exceed the actual charge. Round to cents and allocate remaining cents to the largest fractional remainder, breaking ties by seller-order identifier so statements are reproducible.
Listings, delivery and customer care
Publication, photos and accurate descriptions
Listings need no manual pre-publication approval. Store/category eligibility and bulk-upload rules still apply, and reports/violations may be reviewed afterward. Bulk uploads/imports require prior NineCrafts approval and must remain unavailable until approved. Bots may not automatically create or post listings, even with bulk-upload approval. Approval waives no seller rules.
Describe the actual product, materials, dimensions, quantity, condition, availability, production method, dispatch origin, handling and included contents accurately. Clearly label mockups, personalized previews and meaningful variations. Each physical-product listing needs an original, unedited photo taken by you or your team of the actual item or a genuinely representative finished example. A permitted partner’s inspected finished sample may qualify. Labeled mockups/edited images can supplement, not replace, it. Supply listings instead require the actual-product photo under Supply listings and stock; instructional files require the finished-result photo under Digital downloads.
Use others’ original photos or text only with permission or other legal authority. Do not hide mass production behind a handmade story or substitute cheaper materials without agreement. Show total price and required charges before purchase. Important limitations must be visible in the listing, not hidden in images, shop announcements or post-payment messages. No misleading low-price variants, deceptive discounts, hidden surcharges, fabricated scarcity/identities/sales counts, or unsupported certification, environmental or health claims.
You may sell elsewhere without exclusivity or price parity. Do not move a NineCrafts-started transaction to outside payment to evade its disclosed fees or protections. Legitimate safety reports, warranty support and legally required communications are not fee avoidance.
Dispatch and delivery
Publish realistic processing, dispatch and estimated carrier-delivery dates before purchase. Made-to-order work need not match mass-retailer speed, but must meet the promised date. A label is not dispatch: mark shipped only after carrier handoff or another expressly permitted delivery method, and keep reliable evidence. A missed scan alone does not prove failure to ship; dated receipts and other evidence may establish handoff.
If you cannot ship on time, promptly tell the buyer, offer a realistic revised date, and obtain legally required delay consent or give a prompt refund. Never silently extend a date or mark an unshipped order complete; applicable law governs cancellation/refund timing. Distinguish documented carrier delays, outages and buyer-requested changes from seller-caused lateness. Notify affected buyers and cooperate with carrier inquiries without guaranteeing an outcome.
Use suitable packaging and carrier service, including required hazardous-material declarations/restrictions. Never mislabel perfume, batteries, chemicals or other regulated contents for cheaper shipping.
Customer communication
Provide a working contact route, keep material agreements in the order record, and give a substantive initial response to genuine order inquiries within two business days. You may request needed information and say when a fuller answer will follow; an automated acknowledgment is insufficient. No harassment, discriminatory abuse, threats or demands for unrelated personal information.
You may publish hours/absences and pause new orders when needed. There is no round-the-clock support duty, but planned absences require coverage or resolution of open orders. Nights, weekends, holidays, verified outages, emergencies, spam and abuse must be distinguished from ordinary missed responses. NineCrafts sends a reminder after a missed response period and may escalate the unanswered issue after one more business day; one miss does not automatically close a shop.
There is no minimum sales/revenue, mandatory star average or automatic service-score penalty. A service-failure pattern requires documented facts, relevant exclusions, proportionate action and human review; one unresolved complaint or a tiny sample is not reliable by itself. Before enforcing any future numerical performance program, publish its calculation, review period, exclusions, minimum evidence, correction route and required advance notice.
Reviews and feedback
Product reviews must reflect genuine verified purchases. No bought/sold ratings, sham purchases, connected-account manipulation or rewards conditional on favorable sentiment. Disclose any permitted honest-review incentive and never condition it on sentiment.
Buyers may seek legitimate remedies and describe their experience honestly. Neither side may use abusive-review threats, fabricated reports or coordinated campaigns to obtain an unowed benefit. Never condition an owed remedy on praise, removal of honest criticism or silence.
Honest negative reviews, criticism of NineCrafts and good-faith complaints are allowed. Removal/limitation needs a specific violation, such as fabricated experience, threats, exposed personal information, undisclosed conflicts or proven manipulation, with the reason and a review route. Keep both the decision and its review route recorded and correct improper rating/performance effects as well as content. Sellers may respond factually and report abuse. Distinguish carrier, platform and seller performance; ordinary delivery criticism is not automatically fraudulent, and refund/return does not invalidate a genuine experience.
Returns and order disputes
Publish return/cancellation terms, condition requirements, postage responsibility and permitted deductions before purchase, meeting the minimums below. The checkout terms stay with the order; later edits cannot rewrite them or override these rules or mandatory rights.
For material misdescription, defects, inadequate-packaging damage or non-supply, provide an appropriate correction, replacement or refund despite a “no returns” term. Buyers must give reasonable evidence and cooperate with lawful return instructions; no unsafe returns or unreasonable proof demands.
Subject to law, sellers bear ordinary loss/carrier-damage risk until proper delivery to the agreed address. Valid non-delivery/transit-damage claims require a buyer-acceptable replacement or applicable refund; optional shipping protection is not required. Assess correct-delivery evidence, buyer address errors and theft after proper delivery individually. Sellers are not automatically liable for buyer-caused address errors or post-delivery loss; scans do not defeat credible misdelivery evidence. A remedy alone is not misconduct.
For custom goods, record specifications, proof approval, production stage and cancellation terms. Proof approval does not excuse manufacturing errors. Assess terms/evidence before applying change-of-mind refunds to completed custom work. Digital orders follow Digital cancellations and remedies, not physical-return requirements.
Use the original payment route where supported/lawful, not store credit when money is owed. Disclose unavoidable processing limits. No duplicate charges/recovery or requiring a lawful complaint or review to be withdrawn for an owed refund.
Physical returns and cancellations
- Ordinary returns: request a change-of-mind return within 14 calendar days after delivery and dispatch it within 14 calendar days after usable instructions. Sellers may offer more, not less. Return in substantially received condition apart from reasonable inspection, with included parts and suitable protective packaging; safe equivalent packaging is acceptable.
- Return costs/refund: buyers pay change-of-mind postage. Original separately stated shipping is nonrefundable only if disclosed before purchase; free shipping cannot become a surprise deduction. No restocking fee. Refund within five business days of receiving the return, including inspection within that clock. Deductions for buyer-caused loss need specific evidence, are limited to actual lawful loss and may be challenged; seller-attributable defects/damage are not buyer-caused.
- Disclosed exclusions: genuinely bespoke/personalized goods, opened/used hygiene-sensitive personal care, and consumable supplies already used or irreversibly mixed may be excluded from change-of-mind returns. Standard stock size/color choices are not bespoke. Defect, misdescription, unsafe-goods and non-fulfillment remedies remain.
- Custom cancellation: protected for 24 hours. Earlier work requires the buyer’s express request and recorded agreement that change-of-mind cancellation ends when work starts. After 24 hours, cancellation stays free until custom work actually begins. Thereafter retain only documented work performed and order-specific nonrecoverable costs, capped at order price and lawful amounts; refund the unearned balance. No penalty, hypothetical profit or costs recovered elsewhere.
- Ordinary noncustom cancellation: before actual dispatch, refund the full payment, including original shipping and refundable taxes, without deducting retained processor fees. Printing a label or shipping after receiving timely cancellation cannot defeat it.
Order-claim windows and remedy costs
Report physical damage, defects or material misdescription within 30 calendar days of delivery. Non-delivery cases open after the latest promised delivery date and ordinarily within 30 calendar days of it. Mandatory legal/payment-network rights remain; verified outages, misleading notices or documented circumstances preventing timely filing justify extensions.
For seller-responsible problems, sellers pay reasonable remedy-related shipping. Full-order refunds include original shipping and refundable taxes; partial remedies include affected merchandise and fairly attributable charges, without duplicate recovery. Carrier/insurance recovery is separate and cannot postpone an owed remedy. Never demand unsafe returns; reasonable evidence or safe disposal may replace them. Refund decisions have the separate appeal window below.
Fair order-dispute decisions
Normally, both sides first have a chance to resolve the issue directly, but either may seek help without continuing unsafe or harassing contact. Safety, fraud, an unreachable seller or legal/payment-network deadlines may require earlier intervention.
Before an ordinary disputed seller-funded refund, give both sides the substance of the issue and at least three business days for relevant evidence, with the deadline/time zone stated. Important new evidence or allegations receive a fair response opportunity. Urgent legal, safety or payment-network requirements may shorten this or require earlier action; explain and provide available later review without delaying legally required refunds.
Keep one case record of purchase-time listing/terms, promised dates, changes, proofs, messages, tracking, photos, replacements, refunds and pending returns. A decision must separately explain the buyer’s remedy, who pays, return requirements/postage and seller-performance consequences. Explain any seller-funded no-return refund. Tracking is relevant, not an automatic answer. Refunds/goodwill do not automatically establish misconduct; NineCrafts’ voluntary goodwill does not itself make the seller pay.
Fabricated claims, knowingly false non-delivery reports, switched returns and duplicate recovery are prohibited. A disputed or failed claim alone does not prove abuse; assess evidence without presuming either side right. Ordinary refund decisions may be appealed within 30 calendar days of notice.
Payouts, reserves and holds
Shop and payment restrictions are separate: shop closure does not forfeit money owed. Every reserve, hold, refund, deduction or setoff (using money owed to you against another amount you owe) needs a stated payment-term or legal basis. Reserved funds are not unexplained penalties or NineCrafts revenue.
Records must distinguish ordinary processing, order-dispute holds, reserves, verification and external restrictions, identifying amount, reason, start, release date/conditions, next review and itemized deductions. One order problem does not automatically justify freezing unrelated sales; wider reserves need proportionate account-level reasons. Unrestricted available funds continue normal payouts where law/provider rules permit.
For NineCrafts-controlled reserves, explain amount/percentage, rolling-release math and overlapping holds. New sales cannot restart old release clocks; extensions need updated reasons. Promptly reduce/release funds when the basis ends unless another separately explained restriction applies. You may request a funds review separately from shop reopening, including genuine delivery evidence when tracking integration fails.
Distinguish bank, network, processor or authority restrictions NineCrafts cannot remove and explain available escalation as permitted. Release instructions do not guarantee bank-credit dates. Rapid growth, small size or being new alone is not misconduct. For a real backlog exposure, NineCrafts should consider realistic fulfillment plans, lead times or temporary order limits; NineCrafts need not finance production or release lawfully held funds.
Standard payouts
NineCrafts initiates payouts each Tuesday for available settled funds, or the next business day after a U.S. federal holiday. Later-available funds enter the next scheduled payout. NineCrafts has no minimum balance or extra standard payout fee; disclose provider minimums/charges before payment activation. Show the provider’s estimated bank-transfer time and investigate overdue transfers. Expedited payouts are not offered.
Limits and review clocks
- Ordinary rolling reserve: requires an individualized documented financial-risk reason, not small/new status alone, and cannot exceed 20% of each affected transaction’s net proceeds. Net proceeds means sale/shipping receipts after taxes, disclosed fees, refunds and adjustments.
- Release: each reserved portion becomes available within 30 calendar days after settlement or seven calendar days after verified delivery, whichever is earlier, unless a separately justified transaction hold or external restriction applies. New sales cannot reset these dates.
- Duration: the same underlying reserve lasts at most 90 calendar days, reviewed at least every 30 calendar days and sooner when material evidence resolves concern. At 90 days remove it or separately explain a justified restriction on new orders; no indefinite renewal under another label.
- Internal order-dispute hold: limited to the disputed transaction and actual applicable charges, resolved or released within 60 calendar days. Record supported refunds/debts as such, not indefinite holds; do not double-count exposure across holds/reserves.
- Account takeover/unverified payment destination: never pay a contested or unverified destination. Initial human review within two business days, reassessment every five business days while unresolved, and a secure recovery route are required.
- External restrictions: internal caps do not override independent legal, court, bank, processor or network requirements. Identify the requirement, release conditions and escalation route as legally permitted; update at least every 30 calendar days while held. “Our provider requires it” cannot conceal NineCrafts discretion.
Shipping losses, chargebacks and goodwill
NineCrafts provides no insurance, automatic shipping-loss coverage or blanket chargeback protection. Sellers owe their order/legal remedies and should obtain suitable carrier coverage or insurance for unaffordable losses.
An individual NineCrafts-funded goodwill payment must state amount and purpose, creates no continuing coverage/other-case entitlement, and cannot be charged to a seller without a separate lawful basis. Correcting NineCrafts errors or implementing successful appeals is an obligation, not discretionary goodwill. Product safety applies to every relevant category and NineCrafts retail; category approval never waives law.
Copying and design protection
NineCrafts is a marketplace, not a law firm, trademark office, or patent office. We do not provide legal advice or decide legal ownership of designs, trademarks, patents, or copyrighted works.
For internal marketplace reviews, NineCrafts uses its verified listing records to establish which product was posted first on our site. Posting first does not establish legal ownership, grant exclusive rights, or override a valid infringement notice.
Do not present another maker’s distinctive products, artwork, patterns, digital files, photos, or original listing content as your own. Shared subjects, trends, colors, ordinary materials, techniques, familiar shapes, or general styles alone do not prove copying; minor changes do not automatically make copied work original. Review must consider independent creation, common sources, and lawful licenses alongside marketplace eligibility. Earlier listings, design-registration receipts, timestamps, and reverse-image matches are evidence, not verdicts. Owning a product photo’s copyright does not automatically mean owning every product feature.
Free optional design records
Submit a description, representative images, and creation evidence through the published support or design-record route. NineCrafts acknowledges receipt and its date; updates receive their own dates and are never backdated. These free, private evidence records are not government registrations, ownership proof, exclusive-rights certificates, insurance, or guaranteed protection. They are optional for selling, reporting, responding, appealing, and legal notices; registration or earlier submission gives no automatic advantage. Records remain private except for safeguarded authorized review or lawful disclosure. They are kept until you request deletion or close your account, unless an active dispute or documented legal preservation duty requires retention. Deletion is not an admission against you.
Reporting suspected violations
Only sellers may use the seller-reporting tool to privately report suspected prohibited generic finished-product resale or copying to NineCrafts administrators. Identify the listing, suspected rule, and supporting facts. For copying, also identify the original work, specific copied elements, your connection to it, and whether you allege a marketplace originality violation, legal IP infringement, or both. Useful evidence includes drafts, source files, prototypes, process photos, dated publications, licenses, commission records, and relevant messages. Community reports do not require a large audience, lawyer, or government registration in every case; legal notices have separate requirements. Manufacture country or seller nationality alone is not a violation; eligible supplies and tools remain allowed.
NineCrafts screens for a reviewable issue and enough information, requests missing details, consolidates duplicates, or explains why an unsupported report is closed. Administrative report counts stay private, count unique reporting sellers, and distinguish duplicates. Facts matter, not report volume or coordinated repetition: counts cannot establish guilt, create strikes, suppress shops, or trigger automatic penalties. Credible signs of coordination must be assessed. An unsuccessful report alone is not bad faith. Copying disputes follow the Seller Review Jury process; other eligibility reports use ordinary review and appeal. Buyer order support, safety reports, and legal IP notices remain separate and open to non-sellers.
Seller Review Jury
The jury decides eligible disputed copying complaints under NineCrafts’ originality rules, based on evidence rather than popularity. It is not a court or binding arbitration and cannot decide legal ownership or IP validity, invalidate patents or trademarks, award damages, or replace statutory notices, counter-notices, regulators, or courts. NineCrafts remains responsible for lawful enforcement. Ordinary disputes require the narrowest reasonable protective measure; urgent legal or safety action may precede review only with its own stated basis and review route.
Panel selection and conflicts
Five jurors are drawn randomly from eligible, available, conflict-screened volunteers in a verified, trained seller pool under published eligibility rules. Neither party chooses them, and sales, advertising spend, followers, or staff connections give no advantage. Jurors must be NineCrafts maker sellers or approved supply sellers, including mixed shops, aged at least 18, with at least 90 days’ genuine selling experience on NineCrafts, another marketplace, or an independent shop. They must complete training in originality, evidence, confidentiality, conflicts, and impartiality and accept their obligations. An upheld finding of fraud, deliberate evidence fabrication, serious harassment, or jury manipulation in the past two years disqualifies them; an unresolved allegation does not.
There is no minimum revenue, order count, or follower count, and no advertising purchase or membership payment is required. Dated listings or business records may verify experience without exposing unrelated customer data. Service is unpaid, with no discounts, search boosts, enforcement advantage, or other commercial benefit; declining does not harm a shop. Each owner has one pool identity. A seller may serve on one active case and at most six cases in a rolling year, and cannot serve again on a case involving the same party within twelve months, including an appeal. Commonly owned or managed businesses and household members cannot sit together.
Jurors must disclose conflicts and step aside, including for ownership, employment, common management, financial interests, close family or personal ties, material supplier, customer, partnership, or other business relationships in the previous two years, prior disputes, case campaigns, public commitments to an outcome, direct competition with the disputed product, or other material interests in protecting or removing it. The same broad craft alone is not a conflict, but expertise cannot justify appointing a commercially interested rival. Parties may privately identify conflicts; NineCrafts must investigate and replace conflicted jurors, not let parties reject impartial jurors for a friendlier panel. New conflicts require recusal without penalizing good-faith jurors. Staff may exclude or replace candidates only for documented ineligibility, conflict, refusal, unavailability, or misconduct, never an anticipated vote. Keep auditable selection and replacement records.
Evidence and a fair hearing
The seller receives the specific allegation, rule, affected listings, and enough evidence to answer. Both parties may submit evidence and answer material new evidence, with stated deadlines and time zones and justified extensions where legal and urgent requirements allow. Silence is not an admission, but review may proceed after a fair opportunity to respond. Review never requires admitting wrongdoing, paying a demanded settlement, directly contacting the other party, or obtaining its permission.
The complainant must support the allegation; sellers need not prove an unlimited negative. Missing old sketches alone does not show dishonesty. Similarity scores and AI assessments are screening aids, not verdicts. Allegations, sales, followers, unrelated opinions, general resemblance, suspicion, and repetition do not prove copying. Prior upheld violations may inform a proportionate sanction only after the current violation is established.
All five jurors review the same complete approved record, independently record initial assessments, and privately vote with reasons. Any moderated discussion stays within that record. No public votes, popularity polls, or attached public-comment campaigns are allowed. Questions and new material go through the case process, not private contact with parties or investigations of unrelated social-media controversies; relevant outside evidence must be disclosed for response. At least four jurors must find clear and convincing evidence: specific, reliable evidence creating a firm belief that the identified copying occurred. Missing votes or abstentions are not agreement; replace unavailable or conflicted jurors rather than shrinking the panel. A 3–2 vote means “not established.”
Timetable and decisions
NineCrafts acknowledges reports and begins human screening within two business days. Reporters have seven calendar days to supply identified missing information; reported sellers have seven calendar days after usable notice to respond. Each party may receive one extension of up to seven calendar days for genuine access problems, illness, emergencies, or evidence-gathering difficulty; further extensions need stated reasons. Allow at least three calendar days to answer important new evidence before closing the record. Statutory deadlines take priority.
State the record-closing date. Select the panel within five business days after closure; the decision target is ten business days after closure. Explain delays, outstanding steps, and revised dates, with updates at least every five business days. After twenty business days without a decision, the review lead must personally reassess and justify, narrow, or end continuing NineCrafts-controlled restrictions. Time passing does not prove an allegation.
The written decision records the rule, material evidence, vote count, reasons, action, and appeal route, without juror identities or individual votes. It must find the complaint established, not established on available evidence, outside jury scope, or not yet fairly decidable. “Not established” does not prove originality or dishonesty. Further review must identify what is missing, the next step, and next review date; unresolved allegations alone cannot justify indefinite restrictions.
NineCrafts chooses a proportionate response: no action, correction, removal, warning, or restrictions for serious or repeated established violations. Duplicate reports of one event are not separate violations. Permanent closure requires the separate documented human review under “Marketplace commitments,” not a popularity vote. Departures from jury findings need a specific recorded reason, such as law, a material procedural defect, or evidence the jury could not fairly assess, not staff preference. Continuing restrictions need their own supported reason and review.
Jury appeals and fallback review
Either party may make one ordinary appeal within six calendar months of usable decision notice for an undisclosed conflict, material procedural error, overlooked evidence, important evidence not reasonably available earlier, or a result contrary to the published rule. Good-faith appeals are not misconduct. Original jurors and decision-makers cannot decide the appeal. Fresh copying merits go to a new conflict-free five-person panel with the same four-vote threshold; legal or procedural issues go to a qualified independent reviewer without relevant personal or commercial conflicts. Acknowledge appeals within two business days; target a decision ten business days after the appeal record closes. The same response rights, five-business-day updates, fallback, and restriction review at twenty business days after record closure apply. Non-jury appeals instead use the receipt-based timetable under “Human appeals and corrections.”
If five qualified, conflict-free jurors cannot be seated within five business days after record closure, assign a qualified human reviewer independent of any challenged decision and without relevant personal or commercial conflicts. If none is available internally, NineCrafts must appoint a neutral external reviewer; a conflicted owner, employee, or retail manager cannot substitute while one is arranged. Explain the non-jury review and reason to both parties. Apply the same evidence standard, response rights, reasons, and appeal protections without inventing a panel vote. A fallback appeal uses a different reviewer.
Fallback cannot replace available jury review for convenience or commercial preference. Until an independent reviewer is appointed, continue required updates and separately justify temporary restrictions; staffing difficulties neither prove copying nor permit indefinite restrictions. NineCrafts cannot advertise an active jury service before a trained juror pool, secure evidence handling, conflict checks, and independent review routes exist.
Confidentiality and review costs
Juror identities stay confidential from parties and the public except for required lawful disclosure; confidentiality cannot shield misconduct from review. Keep auditable selection, conflict, voting, and decision records. Share only necessary evidence, removing unrelated personal, payment, customer, and commercial details. A qualified reviewer may verify confidential originals and provide a limited summary. If disclosure cannot support a fair community response, use suitable alternative review or do not rely on that evidence. Submission transfers no ownership or right to use, copy, disclose, or exploit designs. All reviewers must handle evidence securely and confidentially. Jurors use only the approved case system, keep no personal copies, and cannot upload evidence to outside AI tools or reuse it commercially. Access ends with their role; confidentiality continues. Legal notices and counter-notices may require sharing identifying information with the opponent, so anonymity cannot be promised.
Delete or irreversibly anonymize detailed case evidence 180 days after closure, unless a documented legal hold or duty requires longer. A case closes only after the appeal period expires and timely appeals finish. Keep a limited summary for three years after final resolution: case reference, rule, finding, appeal result, action, and selection and conflict audit information, not the full source-file collection. While restrictions continue, retain the minimum necessary record and document reasons for longer preservation. Optional design records follow their separate deletion rule.
Ordinary reports, responses, appeals, and fallback reviews are free. NineCrafts pays appointed external reviewers. Neither party must hire a lawyer or pay a settlement demand to obtain review. Parties pay their own chosen advisers unless a separate lawful agreement or legal decision provides otherwise.
Reporting abuse and retaliation
Do not knowingly submit false reports, fabricate evidence, impersonate rights owners, recruit unchecked claims, make retaliatory purchases or reviews, dox, threaten, harass, reveal jurors’ identities to target them, bribe or pressure them, or contact them outside the case process. Demanding payment to withdraw a knowingly false claim is prohibited. Private conflict reports and compliance with lawful process are allowed, as are separate genuine claims by multiple rights owners, honest witness evidence, lawful criticism, legal advice, regulator contact, and exercising legal rights. Alleged reporting abuse gets separate review and a fair response opportunity. Losing, withdrawing, or failing to prove a complaint alone is not abuse; restrictions on abusive reporting must preserve required legal-notice routes.
Legal intellectual property notices
When NineCrafts receives an infringement notice that meets applicable legal and reporting requirements, we will promptly remove or disable the reported listing and notify the seller. For eligible copyright claims, sellers may submit a counter-notice. We will handle counter-notices and any restoration of content under the applicable legal process. Removal is not a determination that infringement occurred.
Copyright, trademark, patent, and other IP claims have distinct procedures. A jury filing is neither a prerequisite nor a substitute for a valid legal notice to the proper contact. A jury cannot delay legally required action, override court orders, or replace a qualifying copyright counter-notice. Use the IP reporting route or designated-agent contact in NineCrafts’ legal notices, available without login. For the U.S. Section 512 hosting procedure, NineCrafts must register its designated agent with the U.S. Copyright Office, keep public and registered details current, and renew before expiration. These are operating requirements, not confirmation that registration is complete.
Copyright notices and counter notices
A copyright notice must identify the copyrighted work and specific challenged material and location; include claimant contact details and a physical or electronic signature; state a good-faith belief that the owner, agent, or law has not authorized the use; confirm accuracy; and state under penalty of perjury that the reporter may act for the relevant exclusive-right holder. Consider permissions and legally authorized uses, not just similarity. NineCrafts checks required information, identifies omissions for correction, acts expeditiously on qualifying notices, and notifies affected sellers of the action and response route. Knowingly material misrepresentations may create legal liability.
For removal under U.S. Section 512, a counter-notice requires a signature; identification and former location of the removed material; the required good-faith statement under penalty of perjury that removal resulted from mistake or misidentification; the sender’s name, address, and phone number; required consent to federal-court jurisdiction; and agreement to accept service of process. It is not anonymous: required identifying information may go to the claimant. NineCrafts promptly forwards qualifying counter-notices to the original claimant, stating restoration is planned after ten business days, and restores access ten to fourteen business days after receipt unless its designated agent first receives notice that the claimant has filed an action seeking a court order restraining the alleged infringement. Jury deadlines cannot postpone this process. Copyright counter-notices do not answer trademark or patent claims.
Notices, takedowns, retractions, counter-notices, and temporary removals alone do not settle ownership, establish malicious reporting, or constitute final findings for either side. If another restriction remains, explain its independently supported rule violation and review route; never invent a marketplace or noncopyright restriction to evade statutory requirements.
Other rights and repeat infringement
Other IP reports must identify the right, owner or authorized representative, territory, applicable registration or patent number, exact challenged listing, factual basis, and reporter’s signed good-faith account. NineCrafts assesses the relevant right and procedure, not automatically copyright rules, and may request clarification, remove clearly unlawful listings, or obtain qualified review. The jury cannot decide these rights’ validity.
NineCrafts terminates accounts for repeated substantiated infringement in appropriate circumstances and may act sooner for serious or deliberate infringement. Review considers distinct incidents; notices’ reliability and outcomes; retractions; counter-notices; available court information; actual knowledge; and meaningful seller responses. Duplicate reports are not separate strikes. Rebutted or withdrawn claims cannot remain automatic adverse strikes, though withdrawal does not erase independently established wrongdoing. “Substantiated” means a reasonable, documented evidence-based conclusion meaningfully considering the seller’s response, not bare allegations or report volume. It need not meet the jury’s clear-and-convincing standard or await a court judgment.
Two distinct substantiated incidents within twelve months require documented account-level review, not automatic closure or permission for two infringements. Supported repetition outside that period or one serious intentional incident may justify action. Explain reasons, evidence, proportionality, and appeal routes. This process does not require a jury verdict or final court judgment before NineCrafts fulfills applicable legal duties or acts expeditiously on actual knowledge or legally relevant awareness of infringement. NineCrafts must maintain a working notice system, inform account holders of and reasonably implement its repeat-infringer policy, and accommodate without interfering with standard technical measures as defined by Section 512. Publishing these rules alone does not establish safe-harbor eligibility.
Marketplace commitments
Reasons and proportionate action
NineCrafts must give meaningful written reasons for warnings, listing restrictions or removal, enforcement-related visibility limits, selling restrictions, closure, and payout restrictions. Ordinary search-position changes alone are not enforcement. Send notice through the registered contact route and keep it in the case record, accessible outside locked shops. Give notice before or when action takes effect where feasible, otherwise promptly after urgent action, subject only to lawful notice limits. Include:
- The action, effective time, and affected listings, orders, functions, or money.
- The exact rule or legal basis, facts, and useful evidence or summary, distinguishing allegations from findings and stating whether automation materially contributed and whether a person reviewed the action.
- Whether temporary or final, duration or next review date, and conditions for ending it.
- Corrections, response deadline and time zone, and an appeal route usable without login.
- Treatment of existing orders, records, and separately governed payouts.
“Policy violation,” “business risk,” or “our decision is final” alone is insufficient; alleged patterns need relevant examples. Protect personal and genuine security-sensitive information. Document legal limits on detail or timing, give the fullest lawful useful explanation, and provide more when lawful. These limits cannot conceal mistakes or avoid criticism.
Address safe, fixable issues proportionately, ordinarily at listing rather than shop level. Normally allow seven calendar days from notice for non-urgent administrative or listing corrections, stating what must change, the deadline, and time zone. Allow justified extensions when correction is underway without material operating risk. Immediate temporary action may address credible fraud, compromised accounts, serious safety risks, binding legal requirements, or serious or repeated violations creating substantial ongoing risk. Explain why normal correction time was unsafe and distinguish protection from a final finding. Review restrictions at stated review points and on material new evidence; promptly narrow or remove those whose basis ends. Each remaining restriction needs its own reason; extensions need fresh explanations and review dates, not repeated “under investigation” labels.
Permanent closure requires documented human review of evidence, seriousness, relevant upheld history, and narrower alternatives. Report volume, automated scores, competitor demands, or disagreement with lawful criticism cannot alone justify it.
Human appeals and corrections
Sellers may challenge enforcement, account associations, reserves, and order decisions without admitting disputed wrongdoing. Provide a route outside locked shops with appropriate identity checks; a missing button cannot remove review rights. Keep evidence and replies under a case number. Focus requests on genuinely missing evidence, explaining why it matters and updating the next-review date. Do not repeatedly request supplied documents without a specific reason or silently reset the clock. A human independent of the challenged decision must review appeals, including those involving NineCrafts’ retail operation; jury appeals also require their independent panels. Explain the outcome, address material arguments, and state remaining steps. Repetitive submissions raising no new issue may be closed with explanation; material new evidence, verified platform error, or legal requirements can reopen a case.
Reversals require correction of resulting listing or account restrictions, improper violation records and performance effects, and NineCrafts-controlled funds restrictions lacking separate valid grounds. State what was restored and each separately justified remaining restriction. Appeals are not complete while agreed corrections remain unexplained or unimplemented. Restored access does not authorize restarting paid ads, obsolete inventory, or drafts without the seller’s choice. NineCrafts does not promise lost sales, outside traffic, or exact historical search positions can be recreated; required legal remedies remain available.
Filing windows and review targets
Appeal account or listing actions, including jury outcomes, within six calendar months of usable decision notice; ordinary order-refund decisions within thirty calendar days. Challenge payment restrictions anytime money remains restricted. Defective notices, platform access failures, or verified outages extend filing periods as reasonably needed; these windows do not shorten legal rights. Initial human-review targets for all appeals are two business days for closed shops or blocked payouts and five business days for other appeals. Jury appeals follow the record-closure decision and restriction-review timetable above. Other appeals use these targets:
- Decision target: ten business days from receipt, not an indefinitely reset “complete file” date.
- If missing evidence or an external process prevents decision, identify exactly what is needed, why, who must act, and next review date. Sellers normally have seven calendar days for requested evidence, with justified extensions.
- Update at least every five business days during substantive review. Escalate to the review lead after ten business days without decision. At twenty business days, the lead personally reassesses every continuing NineCrafts-controlled restriction, records whether it can narrow or end, and sets the next review point.
These are operating targets, not promised outcomes. Missing one requires escalation and explanation, not automatic approval or unsafe reinstatement.
Orders and records during restrictions
Where safe and lawful, provide limited access or assistance for order records, essential buyer communication, tracking, refunds, payment statements, and appeals. Explain how existing orders will be handled; do not demand fulfillment without a safe way to perform essential steps. An unrelated listing dispute does not automatically cancel open orders. Safety, fraud, inability to fulfill, legal duties, or buyer rights may require cancellation with a separate explanation. Closure does not remove lawful record-retention or customer-remedy duties.
Fair conduct and rule changes
Apply published rules consistently whether sellers are new or established, buy advertising or not, or lawfully criticize the marketplace. Reviewers cannot be rewarded for removing more shops or favoring commercial partners. Search and service standards must not treat small makers as automatically deficient for clearly disclosed longer production times. Advertising follows Fees; NineCrafts retail activity follows the confidentiality and conflict safeguards in “Supplies sold by NineCrafts.”
Clearly communicate material rule and fee changes with an effective date and useful summary. Ordinary material fee or eligibility changes require at least thirty calendar days’ notice to registered seller contact addresses and in seller accounts, including full revised terms and a plain-English summary. Do not silently apply new rules to previously permitted conduct or rewrite completed transactions. Law or urgent safety may require immediate application or shorter notice; explain why and allow as much reasonable transition time as possible.
Starting with its first full month accepting sellers, NineCrafts publishes monthly aggregate enforcement reports by the fifteenth calendar day of the next month. Include actions by type, appeals received and decided, outcomes, review times, overdue cases, and completed corrections; distinguish corrected mistakes from changes based on new evidence or corrected conduct. Combine or suppress small groups for privacy, without revealing identities or security methods. Acknowledge publication delays and give revised dates.
Accounts, verification, and security
Complete payment-provider verification through the provider’s secure process. Keep identity, business, tax, payment, and contact information accurate and current, supply it when legitimately required for selling or legal compliance, and meet verification deadlines. NineCrafts may request information needed for applicable marketplace, tax, sanctions, payment, or consumer-protection laws. It must explain what is needed, why, how to submit it securely, and the consequences of not supplying it, and give legally required warnings and response periods. Neither a jury nor customer service can override statutory verification.
Submit government identifiers and financial documents only through designated secure verification, never public listings, ordinary customer messages, or jury evidence. NineCrafts will apply legally available home-address and personal-contact disclosure exceptions where appropriate, but cannot promise anonymity when disclosure is legally required.
Do not impersonate sellers, hide common ownership to evade restrictions, or use replacement accounts to bypass valid sanctions. Shared internet access, a household address, or a service provider alone is not conclusive proof of the same business; you may challenge an incorrect association. Protect login and authorized staff access and promptly report suspected takeover. A temporary security lock is not a misconduct finding; NineCrafts must provide safe account recovery.
Product safety and prohibited conduct
You are responsible for lawful products, labeling, required testing and certificates, licenses, taxes, warnings, and safe shipping. “Handmade,” “small-batch,” “natural,” or “craft supply” creates no general legal exemption. Do not make unsupported medical, safety, environmental, authenticity, or certification claims; disclaimers such as “not medical advice” do not cure misleading claims.
Stop selling affected products on learning of a credible serious safety problem or recall. Promptly notify NineCrafts, preserve relevant batch and order records, and cooperate with required warnings, reporting, returns, and refunds. Address immediate risks without waiting for a jury. A recalled product may be relisted only after documented completion of an authorized remedy, lawful resale eligibility, and NineCrafts’ review.
Category-specific safety approval
All shops, including mixed shops and NineCrafts’ supply operation, need safety-category approval before selling:
- Cosmetics, perfume, soap, or personal-care goods.
- Candles, wax melts, or fragranced home products.
- Craft chemicals, formulation alcohols, solvents, or resins.
- Children’s products.
- Food-contact products.
- Electrical craft goods, powered equipment, or batteries.
Approval reviews the category and your documented controls, not each product before publication. It is not government certification or a substitute for compliance: every product must meet applicable requirements and be auditable. It does not expand product eligibility or replace the separate supply approvals required under Approved craft supply sales; NineCrafts’ retail boundaries remain under Supplies sold by NineCrafts. The supply-approval section’s free application process, review targets, written reasons, and appeal route also cover safety applications from maker and mixed shops and NineCrafts’ supply operation.
- Cosmetics, perfume, and soap: keep appropriate ingredient, labeling, batch-traceability, and safety records. Meet applicable registration, listing, reporting, and other duties or document an exemption. Do not make unsupported FDA-approval or drug-treatment claims; “natural” or “handmade” establishes neither safety nor exemption.
- Children’s products: provide applicable testing, certificates, tracking information, warnings, and age grading. Small-batch status or an unsupported “not a toy” label is no blanket exemption.
- Food-contact goods: support material and use claims.
- Electrical goods: meet applicable compliance requirements and hold credible safety records for the finished product, not just a component.
- Perfumes and craft chemicals: sell only when lawful, safely packaged, correctly labeled/documented, and carried by an authorized service. Make applicable safety data sheets and handling information available; follow applicable ground-only and dangerous-goods restrictions. Authorized limited-quantity carriage is not automatically banned. Consumer-packaged soap-making alkalis may qualify through this approval process; a craft label does not exempt hazardous chemicals from transport law.
Products not accepted
This version prohibits the following, including NineCrafts-owned merchandise. Maker or supply approval does not override these exclusions:
- Food, beverages, dietary supplements, animal feed, and edible craft kits.
- Drugs, medical devices, and products unlawfully marketed with drug or medical claims.
- Firearms, ammunition, functional weapons intended to injure, and weapon-manufacturing files/kits. Ordinary lawful kitchen and craft cutting tools are not automatically weapons.
- Controlled substances, cannabis/cannabinoid products, tobacco, nicotine, and alcoholic beverages.
- Explosives, compressed fuel gases, radioactive/infectious material, and industrial highly toxic or highly corrosive chemicals outside the expressly approved consumer craft-chemical scope.
- Strollers and car seats, including vintage examples; cribs, bassinets, cradles, other infant sleep products, child restraints, life-saving equipment, and comparable life-critical protective equipment.
- Live animals, live plants, seeds, and propagation material.
- Human remains/body parts and illegally sourced or protected wildlife materials.
- Pornographic content, sexual services, and sex toys.
- Illegal, stolen, counterfeit, unlawfully infringing, or unremedied recalled products; malware; fraudulent documents; and products concealing a known serious hazard.
Customer information and seller content
Use customer information only for order fulfillment, requested support, legal obligations, or another purpose the customer has lawfully authorized. Do not sell it, expose it in public disputes, or add buyers to unrelated marketing lists without required permission. Give fulfillment partners only necessary information and require appropriate protection. Protect retained records and delete unneeded information, subject to lawful retention and dispute-preservation requirements. Promptly notify NineCrafts of possible customer-data or account-access compromise. Never request payment-card security codes, account passwords, or unrelated identity documents through marketplace messages.
You keep the ownership rights you already hold; licensing someone else’s content does not make you its owner. Listing content authorizes NineCrafts to display and technically process it and its previews to operate and promote the listing and marketplace, and deliver purchased downloads to the intended buyer. This grants neither ownership, competitors’ copying rights, nor unrelated resale of files. Uses beyond operating or promoting the listing require appropriate separate rights. NineCrafts needs separate, informed permission to train a general-purpose generative AI model on confidential design submissions or nonpublic source files. Records needed for transactions, evidence, security, and legal compliance may remain after listing removal, as explained in the Privacy Policy.
Responsibilities and legal rights
The identified seller is responsible for its third-party shop goods, files, and order commitments; NineCrafts is the retailer of supplies it sells directly. Marketplace status does not remove NineCrafts’ legal responsibilities. Keep records supporting listings, fulfillment, taxes, and dispute responses. Neither party may destroy relevant evidence after dispute notice. NineCrafts will cooperate with lawful requests from law enforcement, courts, and other authorized government agencies. We will verify the requester’s identity and legal authority and respond as required or permitted by applicable law. Any disclosure of seller or customer information will be limited to the lawful scope of the request and applicable privacy requirements, while protecting unrelated information where law allows.
Marketplace decisions govern access and transaction remedies NineCrafts is authorized to administer, not court damages or conclusive legal ownership. They do not prevent regulatory contact, legal advice, or exercise of available legal rights.
Seller Agreement: accepting these rules
“NineCrafts,” “we,” and “us” mean the business operating NineCrafts.com, whose legal name and contact details must be provided during enrollment. You must be at least 18, legally able to contract, and authorized to bind any business you represent. Selling creates no employment, partnership, franchise, or authority to act for NineCrafts. Your workers and authorized account users must follow these rules.
Acceptance requires an affirmative enrollment or acceptance step recording the version and date, not merely reading this Page. NineCrafts must supply a retainable copy; undisclosed documents or an unidentified contracting party cannot bind you. You agree to ordinary account and contract notices electronically at your registered contact route, without losing legally required alternative notice methods.
These rules govern seller eligibility, marketplace fees, jury review, and enforcement, subject to mandatory law. Separately accepted payment-provider terms govern that provider’s processing duties, not silent changes to NineCrafts’ fee or appeal promises; separately accepted paid-service terms control only that service. Shop policies cannot weaken mandatory law or NineCrafts’ buyer remedies. General clauses cannot cancel specific protections promised here.
Responsibility for third-party claims
If a third party makes a claim against NineCrafts or its personnel because of your unlawful products or content, violation of another person’s rights, material breach of these rules, or negligent or intentional misconduct, you must defend the claim and reimburse reasonable, documented defense costs and losses to the extent caused by your conduct and permitted by law. This is indemnification, not a fine for an accusation or losing a jury case. An allegation alone establishes no responsibility for damages, settlements, or reimbursement. Defense costs remain subject to this section’s coverage and proportionality limits.
NineCrafts must notify you reasonably promptly, provide relevant information, and cooperate at reasonable cost. Late notice reduces your obligation to the extent it materially harms your defense. Defense arrangements and settlements must be reasonable. Neither side may commit the other to an admission, nonmonetary obligation, or unreimbursed payment without that party’s written consent. NineCrafts may use its own lawyer when a genuine conflict requires it, with recoverable costs reasonable and attributable to the covered claim.
You owe nothing for the portion caused by NineCrafts’ negligence, unlawful conduct, fraud, or intentional misconduct, or beyond liability permitted by law. NineCrafts’ assertion alone does not authorize automatic payout deductions for disputed amounts; payment and dispute rules still apply.
Service limitations and limits on damages
Approval, listing review, jury decisions, and originality records are not government certification, legal opinions, insurance, or guarantees of safety, uniqueness, noninfringement, or commercial success. Marketplace tools cannot replace your records, testing, insurance, or professional advice. NineCrafts promises no particular level of sales, traffic, or search placement, or uninterrupted service. Where law permits, service is provided as available, without implied promises of merchantability, suitability for a particular business purpose, or uninterrupted operation. These limitations do not cancel express commitments, warranties for NineCrafts’ own goods, mandatory duties, or nonexcludable rights.
Where law permits, NineCrafts and its personnel are not liable for indirect or consequential business losses from platform use or interruption, including lost sales, profits, or opportunities only when indirect or consequential. Their combined liability for other platform-service claims is capped at the greater of US$500 or NineCrafts marketplace and optional-service fees you paid in the 12 months before the event causing the claim. Processing charges paid to third parties, taxes, and postage do not count as those fees.
Neither exclusion nor cap limits seller proceeds actually owed, required refunds or correction of improper charges, fraud, intentional misconduct, gross negligence, legally nonlimitable personal-injury liability, or other nonwaivable liability. Direct NineCrafts goods remain subject to product and consumer law, not replaced by this service cap. Only an unlawful limitation becomes inapplicable.
Disputes with NineCrafts
First explain the issue and remedy sought in writing through official support or legal contact. NineCrafts will acknowledge it and attempt good-faith resolution for 30 calendar days. This requires no unsafe contact, prevents neither urgent court relief nor regulatory complaints, and shortens no limitation period. Either side may preserve legal rights.
Texas law governs unless controlling federal or mandatory law requires otherwise. A court with lawful Texas jurisdiction may hear disputes; another forum remains available where mandatory law gives a party that right. This agreement imposes no mandatory arbitration or class-action waiver; the seller jury is not arbitration. Small claims remain available in courts with jurisdiction. If a court finds a provision unenforceable, the rest continues where legally possible; not enforcing a rule once is no permanent waiver. Changes follow the earlier notice rules, but material new arbitration, waiver, or indemnity terms require express acceptance, not a routine hidden update.
Closing your account
You may stop new orders and close without a NineCrafts cancellation fee. Complete or lawfully cancel existing orders, settle valid outstanding charges, and keep required records. NineCrafts must provide a way to obtain necessary transaction and payment records after closure, subject to identity and security checks. Closure preserves accrued payment rights, valid refunds and disputes, confidentiality duties, lawful retention duties, and responsibility for earlier conduct. It permits neither indefinite retention of unrelated personal information nor forfeiture of seller proceeds.
